Deviation from the information listed on this application and outlined in the listed “Conditions for Issuance” will result in revocation of this permit. Additional permits may be denied indefinitely. Any burn permit may be revoked at the discretion of the Franklin Fire Department. The issuance of this permit shall not relieve the applicant from any liability from damages resulting from fire nor the obligation to comply with other applicable laws or regulations. The City of Franklin, its officials, employees, or agents do not assume any responsibility or liability in the burning by issuance of this permit.
Conditions for Issuance
GENERAL
- The burning shall not present a health hazard nor generate noxious or toxic fumes.
- The smoke shall not create a public nuisance.
- Disposal of “Wood Waste” is any product which has not lost its basic character as wood such as bark, sawdust, limbs, tree trunks, chips and chemically untreated lumber whose “disposition” by open burning is to solely get rid of or destroy. Priming materials used to facilitate such burning as wood waste and vegetation are limited to #1 or #2 grade fuel oil. Burning of wood waste shall require an “Air Curtain Destructor” or otherwise approved device.
- Open burning of tires, vinyl products, fiberglass/asphalt shingles, Styrofoam products, plastic products and fallen leaves are prohibited.
- No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on any private land unless the location is not less than 50 feet (15.2 m) from any structure and adequate provision is made to prevent fire from spreading within 50 feet (15.2 m) of any structure, or the fire is contained in an approved waste burner located safely, not less than 15 feet (4.6 m), from any structure.
- A garden hose with a shutoff nozzle shall be provided as follows:
- The hose shall be long enough to reach at least 15 feet (4.6 m) beyond the furthest pile.
- The hose shall be connected to a continuous water supply source.
- The hose line shall be always charged with water during the period of burning or a bulldozer with an operator on site is required.
- Burning shall not be permitted before 9:00 AM nor after 3:00 PM.
- There shall be a qualified party assigned the sole duty of attending the fire from the time it is first set until it is totally extinguished.
- All fires shall be within 250 feet (76.0 m) of an approved access road for fire apparatus.
BONFIRE/COOKOUT
- All general conditions apply with the exception of Item #6 where an approved means of controlling the fire shall be present.
- Burning shall not be permitted before 9:00 AM nor after 12:00 midnight, except for cooking-related fires.
- The size of pile to be burned shall be determined by the fire official.
LAND-CLEARNING
- All general conditions apply.
- An “Air Curtain Destructor” or another approved device is required.
DEMOLITION
- All general conditions apply with the exception of Items #1, #3, or #4 when there is no means of controlling.
- A state or local building codes order/permit to demolish the structure by open burning shall be provided to the fire official prior to issuance.
WARMING FIRES
- Maintain at least 15 feet (4.6 m) clearance from structures or flammable materials.
- Warming fires shall not be permitted inside structures.
- Warming fires shall be monitored by a responsible person at all times.
- Warming fires shall be built in metal containers and hardware cloth spark screens provided.
- Warming fires shall use wood waste only.
- Fire extinguishment methods shall be provided for warming fires (water buckets, metal covers, garden hose connected to an established water supply).
- Warming fires shall be extinguished by a responsible person before leaving the site.
