A. Applications are initiated by:

1.The owner of the property that is the subject of the application;
2. The owner’s authorized agent; or
3. The BOMA, the FMPC, the HZC, or the Department of Planning and Sustainability.

B. When the owner’s authorized agent files an application on behalf of the property owner, the agent must provide a property owner affidavit, which binds the owner with respect to all decisions and conditions of approval related to the property.
