The scope of a Rezoning application is to request a change in the district boundaries or district classifications of the Zoning Map.  A rezoning request should be supported by Envision Franklin, the City’s long-range planning document.  Rezonings are reviewed by the FMPC and approved by the BOMA.

Step 1: Preliminary Meeting

A preliminary meeting with staff must take place before an application can be accepted.  To set up a meeting, contact the Current Planning Division of the Department of Planning and Sustainability.

Step 2: Rezoning Application Submittal

The application must be submitted according to the Submittal Schedule through our Online Application Portal.  A pre-application submittal and meeting are not required.  For the list of submittal requirements, see the Rezoning Checklist.  See the Fee Schedule for Application Submittals. 

Step 3: Staff Review

The staff reviews the application and sends comments back to the applicant. 

Step 4: Resubmittal of Corrected Plans

The applicant resubmits corrected plans according to the Submittal Schedule through our Online Application Portal.  The staff determines the completeness of the resubmittal, then it is added to the meeting agenda.  Resubmittal must be within three consecutive resubmittal dates. 

At least 15 days prior to the FMPC meeting date, the applicant mails notification letters to surrounding property owners using addresses that are provided by staff.  The applicant then submits a copy of the Public Notice Letter and a notarized Public Notice Affidavit with the resubmittal set. 

Step 5: FMPC Review

The FMPC reviews the application and provides a recommendation to the BOMA.

Step 6: BOMA Work Session

The item is placed on the next available BOMA Work Session after the FMPC meeting.  The item is discussed, but no vote is taken.    

Step 7: BOMA 1st Reading

If the FMPC voted unanimously in favor of the rezoning ordinance, the 1st Reading may be on the same date as the BOMA Work Session.  The BOMA votes on the 1st Reading of the rezoning ordinance to move it to the 2nd Reading and establishes the Public Hearing date.

Step 8: BOMA 2nd Reading and Public Hearing

The 2nd Reading and Public Hearing occurs one month after 1st Reading, due to public notice requirements.

Step 9: BOMA 3rd and Final Reading

The BOMA takes final action on the rezoning request, which becomes effective upon passage on 3rd and Final Reading.
