The scope of an Annexation application is to request that property be annexed into the city limits.  Annexation is the process by which the city extends its municipal services, laws, taxing authority, and voting privileges to a new territory.

Annexations are considered by the BOMA only when requested by the property owner.  Along with the annexation, the City must adopt a Plan of Services, a Zoning District, and any applicable Overlay Zoning Districts for the property requesting annexation. The following steps outline the process for annexation requests other than those that require a referendum per State law. 

The City reviews annexation requests in a two-step process: initiation and annexation.  The first step, annexation initiation, allows BOMA to determine whether they would like to consider annexing in this area of the Urban Growth Boundary, or beyond, where the property is located.  Should the BOMA determine it is in the best interest of the City to consider annexing in this area, the applicant could proceed to step two, which is the formal annexation application.

Step 1: Preliminary Meeting

A preliminary meeting with staff must take place before initiation application can occur.  To set up a meeting, contact the Current Planning Division of the Department of Planning and Sustainability.

Step 2: Annexation Initiation Submittal

A request to initiate annexation may be submitted anytime and is not defined by the Submittal Schedule but must be submitted through our Online Application Portal.  For the list of submittal requirements, see the Annexation Initiation Checklist.  See the Fee Schedule for Application Submittals.

Step 3: BOMA Work Session

The BOMA discusses whether they would like to consider annexing the requested property and whether the applicant should proceed with a formal application submittal. 

Step 4: BOMA 1st (and only) Reading and Public Hearing

The 1st (and only) Reading and Public Hearing occurs one month after BOMA Work Session, due to public notice requirements.  The BOMA votes on a resolution to consider a full annexation request.

Step 5: Formal Annexation and Plan of Services Application Submittal

The Formal Annexation and Plan of Services application must be submitted according to the Submittal Schedule through our Online Application Portal.  Information required with the application submittal includes an ***NEW*** Owner Affidavit.  For the list of submittal requirements, see the Annexation Checklist.  If the applicant wishes, they may also submit a Rezoning application and, if applicable, a Development Plan application at the same time, to be considered collectively.

Step 6: FMPC Review

The FMPC reviews the plan of services and annexation resolutions, then provides a recommendation to the BOMA.

Step 7: BOMA Work Session

The two resolutions are placed on the next available BOMA Work Session after the FMPC meeting.  The item is discussed, but no vote is taken.

Step 8: BOMA 1st Reading

The annexation resolution is placed on the next subsequent BOMA date for the 1st Reading, unless the FMPC voted unanimously in favor of the annexation.  When this occurs, the 1st Reading may be on the same date as the BOMA Work Session.  The BOMA votes to move the annexation resolution to the 2nd Reading and establishes the Public Hearing date.

Step 9: BOMA 2nd Reading and Public Hearing

The public hearing for the annexation resolution occurs one month after the 1st Reading, due to public notice requirements.  The BOMA votes on the annexation resolution to move it to the 3rd and Final Reading.

The plan of services resolution has one Reading and a Public Hearing, then is placed on the agenda with the 2nd Reading and Public Hearing for the annexation resolution.  The BOMA takes final action on the plan of services resolution, which becomes effective upon 3rd and Final Reading of the annexation resolution. 

Step 10: BOMA 3rd and Final Reading

The BOMA votes on the annexation resolution and it becomes effective upon 3rd and Final Reading.
