02. WAVES, Inc., a tenant of the property located at 145 SE Parkway, appeals the determination of the Fire Marshal and Building Official pertaining to the construction permit and plans disapproval for the requested change of occupancy from Business (B) to Institutional (I-4) that does not include automatic fire sprinklers in an existing building. Specifically, a portion of the building must be classified as an Institutional (I-4) occupancy based upon WAVES programmatic needs consisting of professional offices and a child care facility. The applicable 2009 International Building Code (IBC) Sections include 308.5.2 and (F) 903.2.6 Group I pertaining to automatic fire sprinkler systems.
